Procurement Frequently Asked Questions

  • In the broadest sense, we are a shared services company primarily operating in the credit union and mutual sector. We contract with Suppliers to provide goods and services directly to our Customers, managing the entire procurement process.

    We are uniquely positioned to deliver benefits back to Customers, across industries and sectors, through multiple shared service streams including Procurement, Property, Finance, Legal and Risk.

    We partner with our Customers to gain an understanding of their current business operations, strategic goals and objectives.

    We’re then armed with the information needed to support their procurement strategies, manage contracts, challenge and reinvent traditional processes, monitor risks, predict future demands, develop reliable alternative sources of supply, and tackle ongoing challenges like uncertain decision-making, repetitive processing and the inefficient use of resources.

  • Mutual Marketplace was created in April 2017 via a joint venture between Australia’s two largest credit unions, Credit Union Australia Limited, trading as Great Southern Bank, and Heritage and People’s Choice Limited. Credit Union Australia Limited and Heritage and People’s Choice Limited recognised that in a business environment, the procurement function is one of the most critical.

    However, the procurement function often detracted (in time, energy and resources) from the credit unions’ core business of delivering innovative financial products to its members.

    The solution? Mutual Marketplace, an entity dedicated to offering professional procurement and property lease management services to the mutual banking sector. Since 2017, we have continued to evolve, now providing a full suite of shared services.

    The cost savings and efficiencies Mutual Marketplace has been able to provide to its founding shareholders has resulted in other businesses partnering with Mutual Marketplace.

  • Mutual Marketplace provide a variety of procurement services including:

    • Source to Contract;

    • Supplier and Contract Management; and

    • Procure to Pay.

    We provide these services a number of ways, dependent on our Customer’s needs:

    • End-to-End Procurement Services, where we act as an extension of our Customers as their outsourced procurement partner;

    • Contracting Services, helping our Customers to leverage procurement professionals for their buying activities; and

    • Consulting Services, supporting Customers in project procurement activity providing advisory services.

  • Where Customers engage Mutual Marketplace for End-to-End Procurement Services, the Supplier enters into a contract with Mutual Marketplace to supply goods and services. Mutual Marketplace ensure the contract has provisions for those goods and services to be supplied directly to our Customer(s).

    In circumstances where we use the Supplier contract documents instead of our own, we require that our “Procurement Contracting Provisions” (PCPs) are included in the contract.

    The incorporation of our PCPs is essential to providing End-to-End Procurement Services. Without the provisions, we are not able to ensure goods and services are delivered directly to our Customer, and you will not be able to enforce your rights against Mutual Marketplace if our Customer does something to breach the contract.

  • Legally speaking, Mutual Marketplace.

    However, as covered within the PCPs, where Mutual Marketplace has an operational obligation under the contract, the Customer receiving the benefit of the goods or services will undertake that obligation (and it will be considered to have been done by Mutual Marketplace).

    Where the contract says that Mutual Marketplace is supposed to do something, and it isn’t done by either us or our Customer, then the Supplier can enforce their rights under the contract against Mutual Marketplace. Mutual Marketplace will not be able to say that we aren’t responsible because it was something the Customer should have done.

    If there is a dispute under the contract, the dispute will between Mutual Marketplace and the Supplier. If the Customer suffers any loss as a result of Supplier acts or omissions, the loss is deemed to be Mutual Marketplace’s and we will seek remedies for the loss. If the Supplier suffers any loss as a result of the Customer’s acts or omissions, those acts or omissions are deemed to be acts or omissions of Mutual Marketplace, and the Supplier may seek remedies from Mutual Marketplace for the loss. Mutual Marketplace cannot seek double remedies from the Supplier for both our and the Customer’s loss, and the Supplier cannot seek remedies directly against the Mutual Marketplace Customer.

  • For End-to-End Procurement Services, once a contract has been executed between Mutual Marketplace and the Supplier, the Customer will engage the Supplier via a Purchase Order.

    Mutual Marketplace will provide training to nominated Customer personnel on how to do this.

    Once the supply has been completed by the Supplier, the Supplier will issue the invoice to Mutual Marketplace. The Customer will be notified of the invoice receipt and will review and approve the invoice for payment.

    Mutual Marketplace will then pay the Supplier, within the agreed payments terms.

    Where Mutual Marketplace provide procurement Contracting or Consulting Services to our Customers, Mutual Marketplace have no contractual relationship with the Customers Supplier.
